1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the VaaStay Android application (Package Name: com.vaastay) and associated website at vaastay.pages.dev provided by IITM-Startup ("we," "us," or "our").

By creating an account, browsing listings, or listing a property, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts under Indian law (or your local jurisdiction) to use VaaStay. By using the platform, you represent and warrant that you meet this requirement.

3. Marketplace Role & Scope of Service

VaaStay operates strictly as a peer-to-peer digital discovery technology platform:

• Discovery & Connection: We enable property owners to list verified accommodations (rooms, flats, PGs, shared apartments) and enable prospective tenants to discover and communicate with landlords directly.
• No Brokerage or Agent Agency: VaaStay is not a real estate broker, rental agent, or property manager. We do not own, lease, or inspect listed properties, nor do we act as an escrow agent unless explicitly stated.
• Independent Lease Agreements: Any rental agreement, security deposit payment, rent negotiation, or lease tenure is executed directly and independently between the tenant and the landlord.

4. Landlord & Property Owner Obligations

As a property owner or authorized landlord listing accommodations on VaaStay, you agree that:

• You hold full legal authority or ownership rights to lease the property.
• All listing information, photographs, amenity disclosures, and pricing (monthly rent and deposit) are true, accurate, and up-to-date.
• You will not post misleading, stock, or fraudulent photos, or list accommodations that do not exist or are already occupied.
• You will honor agreed visit schedules and respond to prospective tenants respectfully.

5. Tenant Obligations & Code of Conduct

As a prospective tenant using VaaStay, you agree that:

• You will use the platform solely for legitimate housing discovery.
• You will not use in-app messaging to harass, spam, or solicit property owners for unrelated commercial activities.
• You will conduct standard due diligence and physically inspect accommodations before transferring deposits or lease monies.

6. Intellectual Property Rights

The VaaStay brand, logo, application interface designs, source code, and website styles are the proprietary intellectual property of IITM-Startup. You may not copy, reverse-engineer, modify, or distribute our platform assets without prior written consent.

7. Account Suspension & Termination

We reserve the right to suspend or permanently terminate any user account that violates these Terms, submits fake listings, attempts to charge unapproved brokerage, or engages in fraudulent activity.

You may terminate your account at any time via the in-app Settings & Privacy > Account Security > Delete Account menu or by emailing privacy@vaastay.com.

8. Limitation of Liability

To the maximum extent permitted by applicable law, VaaStay and IITM-Startup shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your access to or use of the platform, including any disputes or financial transactions between tenants and landlords.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Chennai, Tamil Nadu, India.
